Client Accused of Sexual Battery on Minor – Facing a Life Sentence – Case Dismissed!

Our firm recently secured a major victory for an 18-year-old client who was accused of sexual battery, domestic battery by strangulation, and false imprisonment involving his 16-year-old girlfriend. These were extremely serious allegations carrying the potential for a life sentence. Based upon the accusations alone, our client was arrested and initially held without bond.

From the moment we were retained, we acted immediately and aggressively. We conducted our own investigation and uncovered critical evidence that directly contradicted the allegations. This included text message exchanges and social media communications that strongly supported that the interaction was consensual and cast serious doubt on the credibility of the accusations.

We presented this evidence at an evidentiary hearing and challenged the State’s basis for holding our client in custody. After reviewing the evidence and hearing our arguments, the Judge granted our motion and ordered our client released.

We then took the next step and engaged directly with the State Attorney’s Office. By presenting the full scope of exculpatory evidence and highlighting the inconsistencies in the allegations, we demonstrated that the case could not be proven.

The State declined to file charges.  Our client was never formally charged, avoiding the devastating lifelong consequences these allegations carried.
