San Francisco 49ers linebacker Aldon Smith was arrested for DUI early this past Friday following a single-car accident in San Jose. The arrest was Smith’s second DUI arrest. In 2012, Smith was arrested following a nite of too much partying on Miami Beach. In that case, Smith entered the Miami-Dade State Attorney’s DUI Diversion program, Back on Track. The diversion program allows 1st time DUI defendants to complete a year-long out-patient treatment program, have their DUI charges reduced to reckless driving and be eligible to have the record of their DUI case sealed and later expunged.
Smith is likely to face discipline under the NFL’s personal conduct policy.
Smith issued a remorseful statement that he will enter an in-patient program promising that this will not happen again.
